On Monday at 4:41 p.m., Lyon County Sheriff's Deputies were dispatched to the Texaco Gas Station located at 1 Highway 95A in Yerington for a man with a gun.
The reporting party said that a man driving a black Honda pointed a firearm at him and then fled the area in the vehicle traveling north on Highway 95A.
Deputies from the Silver Springs substation located the vehicle on Highway 95A at mile marker 31 and followed it waiting for a safe location to make a traffic stop. Deputies conducted a traffic stop in Weeks (Carson River area just south of Silver Springs). Two occupants were in the vehicle and detained pursuant to further investigation.
The driver was later identified as Juan Carlos Martinez, 23, of Sparks.Martinez admitted that he had a handgun and advised deputies where it was located.
A black semi-automatic handgun was found under the driver seat. A female adult later identified as Precina Desire Black, 25, of Reno, was sitting in the front passenger seat.
Upon further investigation it was determined that Black purchased a cigar from the gas station and attempted to return it as she stated it was stale.
The store clerk refused to refund the purchase so Black started to yell at the clerk and threw the cigar at him.
Black returned to her vehicle and advised Martinez what happened. He became upset and started to approach the store with the handgun in his hand. He argued with the store clerk and then pointed the gun at him. No shots were fired and Martinez and Black fled the scene.
At this point Martinez was arrested for pointing the handgun at the store clerk.
Neither Martinez nor Black possessed a valid driver's license and there was no valid proof of insurance for the vehicle.
The vehicle was subsequently towed and during a routine inventory of the contents deputies found a digital scale with marijuana residue on it and nearly one ounce of marijuana.
Based on the deputies past training and experience in narcotics and drug sales, they suspected that Martinez possessed the marijuana with the intent to sell it based on the fact that he had a digital scale and possessed an amount of marijuana that is considered to be more than personal use for one person.
Since the marijuana was found in the vehicle and both occupants had access to it, Black was also arrested for possession of marijuana.
Black and Martinez were booked into the Lyon County Jail on the following charges:
• Martinez: Possession with the intent to sell marijuana, which is a felony. Aiming a firearm at another person, which is a gross misdemeanor. Driving on a suspended driver license, which is a misdemeanor.
His total bail is set at $8,637.
• Black: Possession of marijuana less than one ounce, which is a misdemeanor.
Her total bail was set at $1,137.
There were no injuries reported as a result of this incident and both subjects were taken into custody without incident.
