NV gov. considers options after AG declines to sue

CARSON CITY — Nevada Gov. Jim Gibbons says he's considering options to move forward with a lawsuit against federal health reform.

The Republican governor issued a statement Tuesday, just hours Democrat Attorney General Catherine Cortez Masto said a lawsuit would be pointless and have little chance of success.

Masto says the Constitution gives Congress broad powers to regulate commerce and spend for the general welfare.

Gibbons says he won't "surrender" to what he calls a federal assault on Nevada's rights. He says several lawyers have offered to pursue Nevada's case for free.

Gibbons says health reform signed by President Barack Obama last week will bankrupt Nevada's Medicaid program and lead to big cuts in education and public safety.

State law clearly says the Attorney General will file suit at the direction of the Governor. If Masto does not want to do her job, we can find someone else come November who will.

(But considering past legal decisions that have come out of her office, Nevada may be better off if anyone OTHER than her handles the suit. IMO she is not a very good lawyer.)
